This agreement and Apple's standard terms

NumiAssist is licensed to you under Apple's standard Licensed Application End User License Agreement (the "Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. The Standard EULA applies in full. The sections below add what is specific to NumiAssist: the subscription, recognition suggestions and your content. If anything here conflicts with the Standard EULA, the Standard EULA prevails.

What data the app handles, and when, is described in our Privacy Policy. The app handles no more than that policy says.

By downloading or using NumiAssist, you accept these terms. If you don't accept them, please don't use the app.

Who provides the app

NumiAssist is provided by Alex Bozhko, an individual ("we", "us"). The app is ours, not Apple's: questions, complaints and claims about it come to us.

Subscription and free trial

NumiAssist has one subscription that includes every feature. It is offered in the App Store in two options:

• NumiAssist Monthly – renews every month;
• NumiAssist Yearly – renews every year.

The price of each option is shown in the App Store and on the subscription screen in the app before you confirm. It is set for your country, so it isn't listed here.

• Free trial. A new subscription starts with a free trial of one week. The trial includes every feature, exactly like the paid subscription. The App Store decides whether your Apple ID is eligible for the trial.
• Payment. Payment is charged to your Apple ID account at confirmation of purchase. If you start with the free trial, the first payment is charged when the trial ends.
• Automatic renewal. The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period, trial included. If you don't cancel in time, the trial turns into a paid subscription.
• Renewal charge. Your account is charged for renewal within 24 hours before the end of the current period, at the price of the option you chose.
• Managing and cancelling. After purchase you can manage or cancel the subscription in your Apple ID account settings: on iPhone, Settings → your name → Subscriptions. Deleting the app does not cancel the subscription.
• Unused trial. If you buy a subscription during the free trial, the unused part of the trial is forfeited.
• Refunds. Payments and refunds are handled by Apple under Apple's rules. Refunds are requested from Apple at reportaproblem.apple.com; we can't issue them ourselves.
• When the subscription ends. You can't start new lots, but lots you have already created stay available to view and export.

Recognition suggestions

Recognition suggestions are optional. Only when you ask for them, photos of the coin's two sides are sent to our server and passed to an external recognition service, as described in the Privacy Policy. The rest of the app works without them and without an internet connection.

Suggestions read what is visible in the photo, such as country, denomination, year and metal. Each comes with a confidence level. Suggestions can be wrong, and nothing enters your description until you confirm it.

NumiAssist does not determine a coin's authenticity, grade or market value. Nothing the app shows is an expert opinion, an appraisal or a guarantee. Check your description before you publish it.

Recognition depends on the internet, our server and the external service, so it may sometimes be unavailable, and we may change how it works.

Your photos and descriptions

Your photos, lots and descriptions belong to you. We claim no rights to them. When you ask for recognition suggestions, your photos are sent for recognition so that suggestions can come back to you; how they are handled along the way is described in the Privacy Policy. We don't currently use your photos to train models. If that changes, it will only be with your explicit consent, through a separate setting in the app.

Your lots live on your device, and we keep no copies. That means we can't restore them if the app is deleted or the device is lost.

Using the app fairly

Use NumiAssist lawfully. You are responsible for your listings: that the photos and descriptions are accurate, that you have the right to sell the coin, and that the listing follows the rules of the marketplace you use and the laws that apply to you and your buyer, including rules on replicas, precious metals and cultural property.

Don't use the app to misrepresent a coin, for example to list a replica as genuine.

Don't send requests to our recognition server other than through the app, and don't try to overload it or get around its protections. If recognition is abused, we may limit access to it.

No warranty and limits of liability

The warranty and liability sections of the Standard EULA apply in full: the app is provided "as is", and liability is limited as that agreement sets out. In plain words:

• We work to keep the app reliable, but we don't guarantee that it will be free of errors or interruptions, or that processed photos, suggestions and descriptions will be accurate or accepted by a particular marketplace.
• We are not responsible for the outcome of your sales: the price you get, disputes with buyers, or a marketplace's decisions about your listings or account.
• Nothing in these terms takes away rights that consumer law in your country gives you and that can't be waived.

Changes to these terms

We may update these terms. The new version appears on this page with a new effective date; if a change is significant, we'll also mention it in the app's release notes in the App Store. If you keep using NumiAssist after the new version takes effect, you accept it.

Language

These terms are written in English, and the English version is the one that legally applies. Translations into other languages are provided for convenience. If a translation differs from the English version, the English version prevails.
